metaPost is available in two editions: the Community Edition and the Professional Edition. The license to use the Professional Edition can be used in one (but not both) of the following scenarios:
* Single user license to use metaPost on an unlimited number of DotNetNuke installations and portals * 10 user license to be used on a single portal.
For example, if you have an organization with 25 staff members who will use metaPost to contribute content to a single portal, then 3 copies of metaPost will need to be purchased. If 15 of those staff members will also contribute to a separate DotNetNuke portal, then an additional 2 licenses need to be purcahsed.
While both editions support use of all metaPost providers, only the Professional Edition supports the following features:

While the interface isn't availble in this initial version of the metaPost Professional Edition, the infrastructure is there for tracking images which are associated with posts. The Ventrian News Articles provider is an example of a provider which was able to take advantage of some of the extended features offered by the metaPost infrastructure. With the News Articles module, content providers are able to add, edit and delete article pages right from within Windows Live Writer. Content providers are also able to set custom News Article properties, such as Featured or Secure, in Windows Live Writer as they are adding a entry.
SOFTWARE LICENSE AGREEMENT This Software License Agreement (this “Agreement”) is made by and between IT Crossing and Licensee, and shall set out the terms, conditions and fee with respect to the license granted by IT Crossing to Licensee for the use of the Licensed Product. In consideration of the mutual agreements and covenants set forth herein, and for good and valuable consideration, the sufficiency of which is hereby acknowledged, the parties hereto agree as follows: 1. License. In accordance with and subject to the terms and conditions of this Agreement, IT Crossing hereby grants to Licensee, under IT Crossing’s intellectual property rights in the Software and Documentation (as defined below), a perpetual, non-exclusive, royalty-free, worldwide license to use the following solely in the manner specified in Section 2 below: (a) the Software and (b) the user guides and manuals for installation and use of the Software, to the extent such user guides and manuals exist and are provided by IT Crossing in electronic format, CD ROM or bound form (the “Documentation”). For purposes of this Agreement, the Software, Documentation and any copies of the same made by Licensee as permitted hereunder are collectively referred to herein as the “Licensed Product.” IT Crossing has no obligation to provide Licensee with any (i) updates, new versions, improvements, enhancements, modifications or derivative works to any of the Licensed Product or (ii) maintenance or support with respect to any of the Licensed Product. 2. License Parameters. Subject to the terms and conditions of this Agreement, Licensee may use the Licensed Product in one of two scenarios, said scenarios not to be used simultaneously. Licensee may install and use Licensed Product on a per user basis for a single user on an unlimited number of DotNetNuke installations and domains. Licensee may also choose to sublicense the use of the Licensed Product for use on a single domain for up to 10 users. For additional licensing options, Licensee should contact IT Crossing directly (http://www.itcrossing.com). Licensee, for its own internal development use, may reproduce the Licensed Product without any additional charge. 3. Ownership. As between the parties, IT Crossing owns all right, title and interest (including, without limitation, all worldwide patent, copyright, trademark and trade secret rights) in and to the Licensed Product. To the extent Licensee makes any Modifications to the Licensed Product as permitted under Section 2 above, as between the parties and subject to IT Crossing’s ownership of the Licensed Product, Licensee shall own all right, title and interest (including, without limitation, all worldwide patent, copyright, trademark and trade secret rights) in and to the Modifications. 4. License Fee. A license to use metaPost on one portal within a DotNetNuke installation is provided in exchange for the current per portal price listed on the site where metaPost is being purchased.
5. Disclaimer of Warranty and Limitation on Liability. (a) WARRANTY DISCLAIMER. THE LICENSED PRODUCT IS BEING LICENSED HEREUNDER “AS IS.” IT CROSSING MAKES NO WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, THAT THE LICENSED PRODUCT WILL MEET LICENSEE’S REQUIREMENTS OR WILL WORK IN COMBINATION WITH ANY HARDWARE OR SOFTWARE APPLICATIONS OR IN ANY ENVIRONMENT, THAT THE OPERATION OF THE LICENSED PRODUCT WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT ALL DEFECTS IN THE LICENSED PRODUCT CAN BE CORRECTED. TO THE FULLEST EXTENT ALLOWED BY LAW, IT CROSSING HEREBY DISCLAIMS ALL WARRANTIES, TERMS, OR CONDITIONS, EXPRESS OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES, TERMS OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, CORRESPONDENCE WITH DESCRIPTION, COMPLIANCE WITH ANY DOCUMENTATION OR SPECIFICATIONS, AND NONINFRINGEMENT. LICENSEE HEREBY ACKNOWLEDGES THAT IT HAS RELIED ON NO REPRESENTATIONS OR WARRANTIES OF ANY KIND IN ENTERING INTO THIS AGREEMENT AND THAT NO REPRESENTATIONS OR WARRANTIES ARE MADE BY ANY OF IT CROSSING’S SUPPLIERS OR AFFILIATES. IT CROSSING NEITHER ASSUMES NOR AUTHORIZES ANY PERSON TO ASSUME FOR IT ANY LIABILITY IN CONNECTION WITH THE LICENSE, INSTALLATION, MAINTENANCE OR USE OF THE LICENSED PRODUCT. (b) LIMITATION OF LIABILITY. NOTWITHSTANDING ANYTHING ELSE IN THIS AGREEMENT OR OTHERWISE, TO THE FULLEST EXTENT ALLOWED BY LAW, LICENSEE HEREBY ACKNOWLEDGES AND AGREES THAT IT CROSSING AND ITS AFFILIATES AND SUPPLIERS SHALL NOT BE RESPONSIBLE OR LIABLE TO LICENSEE OR ANY THIRD PARTY WITH RESPECT TO THIS AGREEMENT OR ANY SUBJECT MATTER OF THIS AGREEMENT (INCLUDING, BUT NOT LIMITED TO, THE INSTALLATION, MAINTENANCE, USE, PERFORMANCE, FAILURE, OR INTERRUPTION OF THE LICENSED PRODUCT), WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY) OR OTHERWISE, FOR ANY (I) INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND, (II) LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, OR OTHER FINANCIAL LOSS OR (III) COST OF PROCUREMENT OF SUBSTITUTE SOFTWARE, DOCUMENTATION, TECHNOLOGY, GOODS OR SERVICES; EVEN IF EITHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ADDITIONALLY, NOTWITHSTANDING ANYTHING ELSE IN THIS AGREEMENT OR OTHERWISE, LICENSEE HEREBY ACKNOWLEDGES AND AGREES THAT IT CROSSING’S TOTAL LIABILITY UNDER THIS AGREEMENT, IN THE AGGREGATE, TO LICENSEE OR ANY THIRD PARTY, AND LICENSEE’S SOLE AND EXCLUSIVE REMEDY FOR ANY MATTER ARISING UNDER THIS AGREEMENT, IS LIMITED TO A REFUND OF ANY LICENSEE FEE PAID UNDER SECTION 4. (c) DISCLAIMER. SOME COUNTRIES, STATES, OR PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, THE LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR CERTAIN PRODUCTS, OR THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY BE LIMITED IN THEIR APPLICATION TO LICENSEE. IF ANY JURISDICTION HAVING APPLICABILITY TO THIS AGREEMENT DOES NOT PERMIT ANY SUCH LIMITATIONS AND/OR EXCLUSIONS, THEN (I) EACH WARRANTY THAT CANNOT BE EXCLUDED SHALL BE LIMITED IN TIME TO NINETY (90) DAYS; AND (II) IT CROSSING’S TOTAL LIABILITY, IN THE AGGREGATE, TO LICENSEE UNDER THIS AGREEMENT SHALL BE LIMITED TO THE LICENSEE FEE PAID UNDER SECTION 4. (d) Basis of the Bargain; Failure of Essential Purpose. Licensee hereby acknowledges and agrees that IT Crossing has set its license fee and entered into this Agreement in reliance upon the limitations of liability and the disclaimers of warranties and damages set forth in this Agreement, and that the same form an essential basis of the bargain between the parties. Licensee also hereby acknowledges and agrees that the limitations of liability and disclaimers of warranties and damages specified in this Agreement will survive and apply even if found to have failed of their essential purpose. Indemnification. Licensee shall indemnify, defend and hold harmless IT Crossing from any and all liability, damages, settlements, costs and expenses (including, without limitation, reasonable attorneys’ fees and costs) resulting from any claim brought or made against IT Crossing based on any (a) covenant, promise, debt or obligation of Licensee (b) unauthorized use of any of the Licensed Product by or on behalf of Licensee or (c) Modification of any Licensed Product made by or on behalf of Licensee. With respect to any claim for which IT Crossing seeks indemnification under this Section 7, (i) IT Crossing shall provide Licensee with reasonably prompt written notice of such claim, (ii) Licensee shall have sole control of the defense and any settlement of such claim, and (iii) IT Crossing shall, at Licensee’s expense, reasonably cooperate and provide reasonable assistance in connection with the defense or settlement of any such claim. 6. Licensee understands that the installation of Licensed Product requires the addtion of a custom entry in the Friendly URLs config file, said entry being made available by a temporary entry to the scheduler where said temporary scheduler entry is removed after it has completed execution. Licensee also understands that use of the Text/HTML provider to allow Windows Live Writer to download the styles of the site to which content is being published requires the manual addition of a custom Text/HTML module to the home page of the site. While Licensed Product is capable of using an existing module for style detection, this is discouraged by IT Crossing. 7. IT Crossing is very pleased to have Licensee as a customer, wishes they did not have to include a lengthy EULA, and hopes that usage of metaPost is fun and productive for each and every user!
